This Privacy Policy relates to information collected by ApSIC, S.L. (referred to in this Privacy Policy as "ApSIC" "we" or "us" or "our") through your use of the ApSIC Xbench website and the ApSIC Xbench desktop software.
“You” or “your” refers to the individual who uses this website, accesses available information, engages with us directly by email or telephone, or uses ApSIC Xbench 3.0 from a computer.

What personal data do we collect about you?
If you purchased an ApSIC Xbench 3.0 subscription, we collect your email and billing details. If you signed up for ApSIC Xbench 3.0, we collect your email. If you use ApSIC Xbench 3.0, we collect the device signature from which ApSIC Xbench 3.0 is used. If you reach us via our website contact or support forms, we collect the information your provide in the forms and subsequent follow-up emails.
How do we obtain your personal data?
We obtain your personal data directly from you. If you are an existing ApSIC Xbench customer, we may also obtain personal data from public sources such as your website or your LinkedIn profile.
How do we use your personal data?
When you use ApSIC Xbench 3.0, your email and device signature is used for license compliance purposes.
Your personal data will be processed for marketing purposes, including sending you marketing materials about ApSIC Xbench by email.
If you are a former or existing customer, your personal data will also be used for these purposes:
- to enable you to enter the Xbench Control Panel and manage your users
- to maintain our business relationship with you or your organization
- our internal reporting
- to provide you or your organization with business proposals
On what legal basis do we use your personal data?

If you are not our former or existing customer then processing of your personal data for commercial communications such as product announcements and price promotions is based on your consent.
If you are our former or existing customer then processing of your personal data is based on our legitimate interest as it helps our business to offer you new products and services, and provide you with some other information about ApSIC Xbench that you may find interesting.
If you use ApSIC Xbench 3.0, the processing of your personal data (email and device signature) is used for license compliance.
How long will we keep your personal data?
We will always keep your personal data for the period for which we maintain an active interaction with you or your organization. We will also keep your personal data where required by law or where we need to do so in connection with potential or actual legal action or an investigation involving ApSIC. Otherwise, data will be held until you opt-out.
With whom do we share your personal data?
Your personal data will be accessible to ApSIC employees. If you contact us via our contact or support forms or via our contact or support emails, personal data provided in contact or support emails will be available to authorized employees of the helpdesk platform provider including in particular, employees of Help Scout, Inc. If you use our forum, personal data provided when signing up in the forum will be available to the forum helpdesk provider including in particular, Discourse Inc. Your personal data might be available to any additional or replacement suppliers we may appoint from time to time.
Transfers of your personal data outside of your home country
ApSIC servers reside in the European Union. Your personal data will also be transferred to the USA if you use our helpdesk service or our forum. The USA may not have data protection laws that provide an adequate level of protection to your personal data.

Protecting your personal data
ApSIC may share your personal data with its suppliers under a written agreement which commits the suppliers to appropriate safeguards in relation to the handling of your personal data (including in relation to maintaining confidentiality of your personal data and implementing appropriate technical and organizational security measures).
ApSIC will take appropriate legal, organizational and technical measures to protect your personal data, consistent with applicable privacy and data security laws.
Your rights
You may be entitled to:
- opt out from your personal data being processed for direct marketing purposes;
- request information regarding the processing of your personal data, including being provided with a copy of your personal data;
- request the correction and/or deletion of your personal data, or object to the processing of your personal data;
- request the restriction of the processing of your personal data; and complain to your local data protection authority, or to a court of law, if your data protection rights are violated. You may be entitled to claim compensation for damages or distress incurred or suffered in consequence of unlawful processing of your personal data.
